In accordance with the Charter of the French Language (as amended by Bill 96), the French version (Conditions d’utilisation) has been made available to you and is the governing version. In the event of any conflict between the English and French versions, the French version shall prevail.

Please read these Terms of Service carefully before purchasing from or using the Secret Skin Co website (secretskinco.com). By placing an order or browsing our site, you agree to be bound by these Terms.

These Terms constitute a legal agreement between you and Secret Skin Co, a sole proprietorship operated in Québec, Canada, and are governed by the Consumer Protection Act (CQLR c P-40.1), the Civil Code of Québec, and other applicable Québec and federal laws.

Secret Skin Co is a small-batch skin care company producing handmade soap bars and related products from grass-fed tallow, based in Gatineau, Québec, Canada.

2. Québec Consumer Protection Act — Key Rights

Under the Québec Consumer Protection Act (CPA), you benefit from important rights that cannot be waived or limited by contract. These include: • The right to clear pre-contract information regarding the merchant’s identity, product description, total price (including taxes and shipping), delivery terms, and cancellation/return policy. • The right to receive a retainable copy of the contract. • If we fail to provide the required information or a proper contract copy, you may have additional cancellation rights under section 54.8 of the CPA. • The right to cancel the contract if goods are not delivered within 30 days (or the agreed timeframe) after the contract is formed. • Legal warranties under the Civil Code of Québec: goods must be fit for their ordinary purpose, free from latent defects, and durable for a reasonable period given the price and normal use.

3. Products and Ordering

3.1 Product Descriptions

We strive to describe and display our products accurately. However, as each item is handmade in small batches, slight variations in colour, texture, weight, and scent may occur. Colours and textures may also appear differently on screen than in person.

All soap bars and related products contain tallow derived from grass-fed cattle and are not vegan. Please review the full ingredient list on each product page. If you have allergies or sensitivities, consult a healthcare professional before use. Nothing on our website constitutes medical or dermatological advice.

3.2 Pricing and Taxes

All prices are in Canadian dollars (CAD). Applicable taxes (GST and QST) and shipping charges are calculated and shown at checkout. We may adjust prices at any time, but the price confirmed at the time of your order will apply.

3.3 Order Confirmation

Before you complete your purchase, you will see a clear summary including: • Products ordered and descriptions • Total price (including taxes and shipping) • Estimated delivery timeframe • Your statutory and voluntary cancellation/return rights

This satisfies the pre-contract disclosure requirements of the CPA.

4. Shipping and Delivery

4.1 Processing Time

We aim to process and ship orders within 48 hours on business days (Monday to Friday, excluding Québec and federal statutory holidays). Orders placed on weekends or holidays will be processed the next business day.

4.2 Delivery

Delivery timeframes are estimates only and not guaranteed. We are not responsible for delays caused by the carrier, weather, customs, or other events beyond our reasonable control. Risk of loss or damage passes to you upon delivery to the address provided.

For international orders, any customs duties, taxes, or import fees are your responsibility.

4.3 Free Shipping

Free standard shipping is offered on qualifying orders over $40 CAD (after discounts) to addresses within Canada. We may modify or discontinue this offer at any time.

5. Cancellations, Returns, and Refunds

5.1 Statutory Rights under the CPA

You may cancel a distance contract in certain circumstances under the CPA, including: • If we failed to provide required pre-contract information or a proper retainable copy of the contract (section 54.8). • If goods are not delivered within 30 days (or the agreed time).

To exercise any statutory cancellation right, notify us in writing at info@secretskinco.com. We will process a full refund within 15 days, as required.

5.2 Satisfaction Guarantee

In addition to your statutory rights, we offer a voluntary 30-day satisfaction guarantee. If you are not fully satisfied with your purchase for any reason, contact us within 30 days of delivery. We will issue a full refund to your original payment method. You are not required to return the product. This guarantee is limited to one order per customer and does not affect your rights under the CPA.

5.3 Damaged or Incorrect Orders

If your order arrives damaged or incorrect, please contact us within 7 days of delivery with a photo. We will, at your choice, send a replacement or issue a full refund.

5.4 Refund Processing

Approved refunds will be issued to your original payment method within 15 days of receiving your request.

6. Payments

We accept major credit cards and other methods shown at checkout. Payments are processed securely through our provider. We do not store full credit card details. By providing payment information, you confirm you are authorized to use it.

7. Privacy and Personal Information (Law 25)

We collect and handle your personal information in accordance with Québec’s Act respecting the protection of personal information in the private sector (as amended by Law 25 / Bill 64) and the federal PIPEDA where applicable.

See our separate Privacy Policy (available on the website) for full details, including how we collect, use, and protect your data, your rights of access, correction, deletion, and withdrawal of consent, and our appointment of a privacy officer.

We use your information only to process orders, communicate with you, and (with your consent) send marketing messages.

8. Email List and Marketing

By subscribing to our email list, you give express consent to receive commercial electronic messages from Secret Skin Co, in compliance with Canada’s Anti-Spam Legislation (CASL).

You may unsubscribe at any time by clicking the unsubscribe link in our emails or by contacting us at info@secretskinco.com. Every marketing email will include our contact information and a functional unsubscribe mechanism.

9. Intellectual Property

All content on this website (text, images, logos, branding) is owned by Secret Skin Co and protected by the Copyright Act (Canada) and Québec law. You may not copy, reproduce, or create derivative works without our prior written permission.

Any reviews or user content you submit grants us a non-exclusive, royalty-free license to use it for marketing and promotional purposes.

10. Limitation of Liability

Nothing in these Terms limits any rights or remedies you have under the Québec Consumer Protection Act or the Civil Code of Québec that cannot be waived.

To the maximum extent permitted by law, our total liability for any claim arising from your purchase shall not exceed the amount you paid for the relevant order. We are not liable for indirect, consequential, or punitive damages except where prohibited by law.

11. Governing Law and Disputes

These Terms are governed by the laws of the Province of Québec and applicable federal laws of Canada. Any disputes shall be subject to the exclusive jurisdiction of the courts of Québec.

You may also file complaints with the Office de la protection du consommateur (OPC) at opc.gouv.qc.ca.

12. Changes to These Terms

We may update these Terms from time to time. Material changes will be notified by email to customers with accounts and posted on the website. Your continued use of the site after changes constitutes acceptance of the updated Terms.
